USER CONTRACT:

ARTROM Gallery and the websites and www.artromgallery.com were developed and are managed by Genovesi Design Studio.
This User Contract is a contract between us and those who register to enter their images in one or more of our juried Competitions, those who become Members of the ARTROM GALLERY GUILD or who have a ONE PERSON SHOW.
We agree to provide services and content on the website www.artromgallery.com subject to the following conditions. Please read them carefully. Your use of the website as a registrant or as a member of Artrom Gallery means you agree to these conditions.

A. YOUR USE OF THE SITE

1. Registration and Membership
You agree to provide only true, accurate, current and complete information on all phases of registration and to accept responsibility for all activities that occur under your account. Using a name other than your own legal name is prohibited.

2. Communications with Third Parties Through the Site.
Your dealings or communications through the website www.artromgallery.com with any party other than us are solely between you and that third party.
Please review carefully that third party's policies and practices and make sure you are comfortable with those policies and practices before you engage in any transaction. Any complaints, concerns or questions you may have relating to materials provided by third parties should be forwarded directly to the third party.

We are committed to respecting your privacy rights. This Privacy Policy discloses the general privacy practices for the website www.artromgallery.com and ARTROM Gallery.

1. Information Collected

In the process of participating in the website artromgallery.com, you will be asked to provide information or provide certain content that personally identifies you ("Contact Information"). Such Personal Information may include your name, phone number, street address, and e-mail address, etc. On any page that collects Contact Information, we will specifically describe what information is required in order to provide you with a service, enter a Competition, or register to become a Member.

We believe in protecting your privacy, and will not share Contact Information with third parties outside of Artrom Gallery except as described in this Privacy Policy.

We may use your Contact Information, such as your e-mail address or mailing address, to contact you regarding interest expressed in your work by a gallery, or by someone interested in purchasing your work, to respond to an inquiry, or to respond to your comments and suggestions.
We use no cookies.

3. Disclosure

This Privacy Policy only addresses the use and dissemination of information that we collect from you. If you disclose any information to other parties, through, for example, email, personal ads, or the like; through third party services or promotions offered on or through the website www.artromgallery, we shall not be responsible for the use or dissemination of such information.

C. COPYRIGHT, TRADEMARK AND PROPERTY RIGHTS

All of the information, content, services and software displayed on, transmitted through, or used in connection with the website www.artromgallery.com, including text, photographs, images, illustrations, html, source and object code, software, data, and the like (collectively, the "Content"), is owned either by the participating artists or ARTROM Gallery. We actively protect our rights to the Content to the fullest extent of the law. Visiters may not use such material except as provided in this User Contract.
Images submitted for review remain the property of the artist. No claim shall be made by ARTROM Gallery for the copyright, trademark, or property rights of the images submitted, nor shall they be commercialized or reused in any way.

D. USER'S REPRESENTATIONS AND WARRANTIES

You represent, warrant and covenant (a) that no materials of any kind submitted by you and/or through your membership account will (i) violate, plagiarize, or infringe upon the rights of any third party, including copyright, trademark, privacy or other personal or proprietary rights; or (ii) contain libelous or otherwise unlawful material; and (b) that you are at least thirteen (13) years old.
You hereby agree to indemnify, defend and hold harmless ARTROM Gallery, from and against any and all liability and costs, including reasonable attorneys' fees, incurred by ARTROM Gallery in connection with any claim arising out of any breach by you or any user of your account of this User Contract or as reasonably required in the defense of any such claim.

E. GENERAL DISCLAIMER AND LIMITATION OF LIABILITY

While we use reasonable efforts to include accurate and up-to-date information on the website www.artromgallery.com, we make no warranties or representations as to the accuracy of the Content and assume no liability or responsibility for any error or omission in the Content. You expressly understand and agree that use of the website www.artromgallery.com is at your own risk. All content available through the site is provided on an "as is" and "as available" basis. We make no representation or warranty of any kind regarding the site, the content, any advertising material displayed on the site, or the results that may be obtained from use of such services or sites, including but not limited to that the site be uninterrupted, timely, secure or error free, or that the site or the server that makes it available are free of viruses or other harmful components or destructive files.

In no event shall ARTROM Gallery or the website www.artromgallery.com be liable for: (i) any indirect, consequential, special, incidental or punitive damages including, without limitation, damages related to unauthorized access to or alteration of your transmissions or data, the content or any errors or omissions in the content, even if advised of the possibility of such damages; and/or (ii) any amount for direct damages.

F. Children's Privacy

In accordance with the Children's Online Privacy Protection Act of 1998, we will never knowingly request or solicit personally identifiable information from anyone under the age of 13 without verifiable parental consent. In the event that we receive actual knowledge that we have collected such personal information without the requisite and verifiable parental consent, we will delete that information from our database.
